A LOCAL LAW AMENDING CHAPTER 122 OF THE CODE OF THE VILLAGE OF MONTGOMERY ENTITLED “ZONING” TO ESTABLISH LIMITS ON THE NUMBER OF WINDOW SIGNS PEMITTED FOR BUSINESS AND INDUSTRIAL USES.
BE IT ENACTED by the Board of Trustees of the Village of Montgomery, New York as follows:
SECTION 1. Legislative intent.
The Board of Trustees finds and determines that many businesses in the Village display numerous and various types of signs in the windows of their establishments. While the Board understands the reason for businesses to advertise their products, promotions and sales, this practice has led many business owners to post an excessive number of signs on their windows such that, in some cases, every inch of window space is covered. The Board of Trustees believes that this excessive signage detracts from the historic and aesthetic beauty of the Village. The Board of Trustees, therefore, determines that certain modifications to the sign laws of the Village are necessary to avoid this blight caused by excessive signage. The Board of Trustees also determines that the proposed changes will enhance the land use policies of the Village, will protect property values, enhance and protect the physical appearance of the community and encourage a better business environment.
SECTION 2.
Article VIII of Chapter 122 of the Code of the Village of Montgomery entitled “Signs” is hereby amended to add a new Section 122-36.1 as follows:
122-36.1 Window Signs
In addition to the other signs permitted in this Article, no business establishment, regardless of the Zoning District in which it is located, shall be permitted to display window signs where the total area covered by said window signs exceeds 25% of the total window area of each window of such establishment.
SECTION 3. SAVINGS CLAUSE.
If any clause, sentence, paragraph, section or part of this Local Law shall be adjudicated by any court of competent jurisdiction to be invalid, such judgment shall be confined in its operation to the clause, sentence, paragraph, section or part thereof directly involved in the controversy in which such judgment shall have been rendered.
SECTION 4. Effective date.
This Local Law shall take effect immediately upon filing in the office of the Secretary of State in Albany in accordance with section 27 of the Municipal Home Rule Law.
